A.01The Service

willisellit.com offers two products:

• Free diagnostic tool — an interactive questionnaire that produces an educational sale-readiness verdict, an estimated price range, recommended marketplace fits, and a fix-list. Provided at no cost, with no signup or email required.
• Paid sponsor placements — a $99/month recurring subscription that displays your product (logo, name, one-line description, and link) in rotating sponsor slots on the site. Subject to moderation approval.

A.02Estimates are not advice

The Service is not a licensed financial advisor, broker, accountant, or attorney. The verdict, price range, marketplace recommendations, and any other output are algorithmic educational estimates based on indie-business sale comparables and indicative weights documented on our methodology page. They do not constitute:

• An offer or solicitation to buy or sell any business or asset
• Financial or investment advice
• Tax or accounting advice
• Legal advice
• A binding valuation, appraisal, or expert opinion

Real sale prices may vary by 20–30% or more from our estimates. Always consult qualified professionals (broker, accountant, attorney) before making decisions involving the sale of a business.

A.03Eligibility

You must be at least 18 years old and capable of entering a binding contract. Sponsor subscriptions are for businesses or individuals legally permitted to advertise their product or service in their jurisdiction.

A.04Sponsor placements

Application + moderation

Submitting a sponsor application does not guarantee acceptance. We review every submission for fit and policy compliance and will respond within 48 business hours. We reserve sole discretion to approve, reject, or request changes to any submission for reasons including (but not limited to) brand fit, content policy, technical quality, or legal concerns.

Pricing + billing

• $99 USD per month, billed as a recurring subscription.
• Payments are processed by Creem.io, our Merchant of Record. Creem invoices, charges, and remits applicable taxes. By subscribing, you also agree to Creem's Terms.
• The first charge occurs only after your submission has been approved and you confirm via the payment link sent to your email.
• Renewal: the subscription renews automatically each month at the same rate until cancelled.

Cancellation

• You may cancel at any time directly from your Creem customer portal (link in every billing email) or by emailing [email protected].
• Cancellation takes effect at the end of the current billing period. Your sponsor placement remains live for the remainder of that period.
• No further charges are made after cancellation.

Refund policy

• Within 7 days of any charge: you may request a full refund for any reason by emailing [email protected]. We process refunds within 5 business days.
• After 7 days: charges are non-refundable on a per-period basis, but you can cancel future charges anytime (see above).
• Service-failure refunds: if we fail to display your sponsor placement for more than 24 consecutive hours due to our fault, we will issue a prorated refund on request.
• Refunds are issued to the original payment method via Creem.

Sponsor content rules

Sponsor content (name, description, link, logo) must:

• Accurately represent your product or service.
• Link to a working, non-malicious destination URL.
• Not infringe trademarks, copyrights, or other intellectual property.
• Not promote prohibited categories (see A.07).
• Not contain false claims, deceptive testimonials, or fake metrics.

We may edit or remove sponsor content at any time if it falls out of policy. In such cases we issue a prorated refund for the remaining period.

A.05Free diagnostic tool

The free tool is provided "as is" without warranty of any kind. We may modify, throttle, suspend, or discontinue it at any time. We do not retain your individual answers — they live only in your browser session and (optionally) in the verdict URL hash if you bookmark it.

A.06Verdict ratings

Optional 1–5 star ratings of the verdict are voluntary, anonymous, and aggregated. We reserve the right to discount or remove ratings that appear to be from automated sources or coordinated abuse.

A.07Prohibited uses

You may not use the Service to:

• Submit sponsor content for: gambling, adult content, weapons, controlled substances, MLM/pyramid schemes, predatory lending, financial services requiring unheld licenses, regulated medical claims, counterfeit goods, or anything illegal in your or our jurisdiction.
• Advertise an AI tool that produces NSFW, deepfake, or face-swap content.
• Submit false metrics, fake reviews, or misleading claims about your product.
• Scrape, mass-submit, or otherwise abuse the diagnostic tool or rating system.
• Attempt to bypass moderation, rate-limits, or authentication on the admin panel.
• Reverse-engineer, decompile, or interfere with the Service's technical operation.
• Use the Service to violate any applicable law, regulation, or third-party right.

A.08Intellectual property

The Service's source code, design, copy, methodology, mascot, and brand are owned by us or licensed to us. You may not copy, modify, or redistribute them without our written permission. Exception: you are welcome to share verdicts, screenshots, and links from the diagnostic tool — that's the point.

Sponsor content (your name, description, logo, link) remains your property. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to display, format, and rotate it through the sponsor slots for the duration of your subscription.

A.09Third-party links and recommendations

The Service references and links to third-party marketplaces (Acquire.com, Empire Flippers, Flippa, ExitBid, Microns, and others). We are independent and not affiliated with any marketplace. We do not earn commissions on referrals. Marketplace recommendations are based on our methodology, not on affiliate revenue.

Sponsor placements are clearly labelled as such and are not editorial endorsements. We do not vet sponsor products beyond initial moderation; transactions you have with sponsors are between you and them.

A.10Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

A.11Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claim arising from or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental or consequential damages — in those cases, the above limits apply only to the extent permitted by law.

A.12Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from your sponsor content, your use of the Service, or your violation of these Terms.

A.13Suspension and termination

We may suspend or terminate your sponsor placement and access to the Service at any time, with or without notice, for material breach of these Terms, Creem's Terms, or applicable law. On termination for non-breach reasons, we issue a prorated refund for the unused period.

A.14Governing law and disputes

These Terms are governed by the laws of the country in which the operator is registered, without regard to conflict-of-laws rules. The specific entity and jurisdiction will be disclosed at checkout and on each Creem invoice. Disputes arising from these Terms shall be resolved exclusively in the courts of that jurisdiction, unless mandatory consumer-protection rules in your country require otherwise.

Before filing a formal dispute, please email [email protected] and we will work in good faith to resolve the issue.

A.15Payment processor (Merchant of Record)

All paid transactions are processed by Creem.io, who acts as our Merchant of Record. Creem is responsible for:

• Charging your payment method
• Issuing invoices
• Calculating and remitting sales tax / VAT in applicable jurisdictions
• Providing the customer portal for subscription management and cancellation
• Processing refunds we authorize

By subscribing, you also agree to Creem's Terms of Service and Privacy Policy.

A.16Changes to these Terms

We may update these Terms. Material changes will be highlighted at the top of this page with a new effective date and emailed to active sponsors. Your continued use of the Service after the effective date means you accept the updated Terms.

A.17Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

This Part describes how willisellit.com collects, uses, and protects your information. Payments for sponsor placements are processed by Creem.io, our Merchant of Record. Their privacy practices apply to payment data; ours apply to everything else.

B.01Information we collect

Information you provide

• Sponsor submissions: when you apply to advertise on the site, we collect your product name, description, link, contact email, and (optionally) a logo image you upload or a URL.
• Verdict ratings: when you rate the diagnostic output (1–5 stars), we record only the star value — no name, no email.
• Contact form submissions: if you email us, we store your message and email address only as long as needed to respond.

Information collected automatically

• IP address: recorded with sponsor submissions and rating votes for spam prevention and rate-limiting. We do not use IP for tracking or profile-building.
• User agent string: recorded with sponsor submissions to help diagnose abuse.
• Cloudflare network logs: our hosting provider Cloudflare maintains routine access logs (timestamp, IP, URL) for DDoS protection and uptime. See Cloudflare's Privacy Policy.

Information we do not collect

• We do not require accounts, signups, or email addresses to use the free diagnostic.
• We do not use third-party analytics (no Google Analytics, no Mixpanel, no tracking cookies).
• We do not store your business answers (asset type, MRR, churn, etc.) on our servers — they live only in your browser session and the URL hash if you bookmark a verdict.
• We do not sell or rent personal data to third parties.

B.02How we use your information

• Sponsor submissions are reviewed by us to approve, edit, or reject the placement. If approved, the product name, description, link, and logo become publicly visible on the site as a sponsor card.
• Sponsor email addresses are used solely to send you a payment link, billing-related correspondence, and renewal reminders.
• Ratings are aggregated to show an average score on the site. No individual rating can be traced back to a person.
• IP addresses are used for rate-limiting form submissions and one-vote-per-period rating throttles. They are not exposed to third parties or used for any other purpose.

B.03Cookies and local storage

We use only the bare minimum:

• sessionStorage ("wis-rated") to suppress the rating modal in the same browser tab — clears when you close the tab.
• sessionStorage ("wis-admin-token") used by the admin panel only — irrelevant for end users.
• No tracking cookies. No advertising cookies. No third-party cookies.

B.04Sharing your information

We share information only with the following recipients, and only for the purposes listed:

• Cloudflare — our hosting and edge-CDN provider. They process traffic in transit (no application-level access to your data).
• Creem.io — our payment processor and Merchant of Record. They handle billing data (card numbers, billing address, invoices) for sponsor subscriptions. We never see or store full card details.
• DuckDuckGo Icons — when a sponsor's logo is auto-pulled from a website's favicon, the request goes to icons.duckduckgo.com. The sponsor's domain name is sent to DuckDuckGo as part of that request.
• Legal authorities — only if required by valid legal process and we have no reasonable alternative.

B.05Your rights

Under GDPR (EU residents)

• Access — request a copy of any personal data we hold about you.
• Rectification — ask us to correct inaccurate data.
• Erasure ("right to be forgotten") — ask us to delete your data, subject to legal retention requirements.
• Restriction — ask us to pause processing while we verify a dispute.
• Portability — receive your data in a machine-readable format.
• Objection — object to processing on legitimate-interest grounds.
• Complaint — file a complaint with your national data-protection authority.

Under CCPA (California residents)

• Right to know what personal information we have about you.
• Right to delete personal information.
• Right to opt out of sale or sharing of personal information — although we do not sell or share personal information for cross-context behavioural advertising.
• Right to non-discrimination — we will not penalise you for exercising any of the above.

To exercise any of these rights, email [email protected] with the subject line "Privacy request". We respond within 30 days.

B.06Data retention

• Sponsor submissions: kept while the sponsor is active and for up to 24 months after cancellation, for billing audit and dispute resolution. Rejected submissions are deleted within 90 days.
• Rate-limit IP records: auto-expire after 1–24 hours.
• Aggregated ratings: kept indefinitely but contain no personal data.
• Email correspondence: kept for up to 24 months for support history.

B.07Data security

All traffic is served over HTTPS with TLS 1.2 or higher. HSTS is enforced for 6 months. Data at rest is stored in Cloudflare's encrypted KV storage. The admin panel is protected by a strong password and IP-throttled login. We do not store payment card numbers — Creem.io handles those via PCI-DSS-compliant infrastructure.

B.08International transfers

Cloudflare's edge network is global. When you visit the site, your request is served from the geographically closest Cloudflare datacentre. Sponsor data is stored in Cloudflare KV with regional replication. Creem.io handles payment data subject to its own cross-border transfer terms (see Creem's privacy policy).

B.09Children

The Service is not directed to anyone under 16. We do not knowingly collect personal data from children. If you believe we have, email us and we will delete it.

B.10Changes to this Privacy Policy

We may update this section. Material changes will be highlighted at the top of this page with a new effective date. Continued use of the Service after changes means you accept them.
